1. Agreement and acceptance
These Terms of Service ("Terms") govern your access to and use of the ATOMIC Labs interface, website, and related services (collectively, the "Service") operated by or on behalf of ATOMIC Protocol ("we," "us," or "ATOMIC"). The Service provides a Solana-native conviction protocol interface: it lets you connect a wallet, view token and market data, create conviction locks (time-weighted escrow positions), trade via integrated third-party DEX routing, and maintain an on-app profile and reputation metrics. By connecting your wallet, signing in, or otherwise using the Service, you agree to these Terms. If you do not agree, do not use the Service.
2. Eligibility
You must be at least 18 years old and have the legal capacity to enter into a binding contract in your jurisdiction. You must not be located in, resident in, or a citizen of any jurisdiction where use of the Service or participation in the protocol is prohibited or restricted by law. You are solely responsible for determining whether your use complies with applicable law. We may restrict or block access from certain countries or regions at our discretion.
3. Nature of the service; no custody
The Service is a non-custodial interface. We do not hold, custody, or control your digital assets or private keys. When you connect a wallet (e.g., via Dynamic Labs or a supported Solana wallet), you retain full control. Transactions you approve (locks, swaps, or other on-chain actions) are executed on public Solana infrastructure and are your responsibility. We do not execute transactions on your behalf without your explicit approval in your wallet. Token and market data (e.g., from Jupiter, DexScreener, or other data providers) are provided for information only and may be delayed or inaccurate.
4. User obligations
You agree to:
- Provide accurate profile information when you set up your operator identity and not impersonate others or misrepresent your affiliation.
- Keep your wallet credentials and any account credentials secure; we are not responsible for lost or stolen keys or unauthorized access.
- Use the Service only for lawful purposes and in accordance with these Terms and applicable law.
- Not use the Service to launder money, evade sanctions, or violate securities, commodities, or other financial regulations.
- Not attempt to probe, disrupt, or overload our systems or third-party services we rely on (e.g., RPC, Dynamic, data APIs).
5. Conviction locks and on-chain actions
Creating a conviction lock means you are committing assets to an escrow arrangement on Solana for a chosen duration. The mechanics, rewards (e.g., conviction points, reputation), and risks are described in our documentation and whitepaper. You are solely responsible for understanding the smart contracts and economic terms before locking. We do not guarantee any particular outcome, APY, or reward. Swaps and other trades are routed through third-party DEX aggregators (e.g., Jupiter); we are not the counterparty and do not guarantee execution price or liquidity.
6. No financial or legal advice
Nothing on the Service constitutes financial, investment, tax, or legal advice. We do not recommend any particular asset, lock, or trade. You should conduct your own research and, if needed, consult qualified professionals before making financial decisions. Digital assets are volatile and high-risk; you may lose some or all of your value.
7. Third-party services
The Service depends on third parties, including but not limited to: Dynamic Labs (authentication and wallet connection), Solana RPC and indexer providers, Jupiter (swap routing), DexScreener and other market data sources, and hosting/infrastructure providers. Your use of those services may be subject to their own terms and policies. We are not responsible for their availability, accuracy, or conduct. Links to external sites (e.g., Ecosystem, Twitter) do not imply endorsement.
8. Intellectual property
The Service, including its design, text, graphics, logos, and software (excluding open-source components used under their respective licenses), is owned by or licensed to ATOMIC. You may not copy, modify, distribute, or create derivative works of our proprietary materials without written permission. You retain ownership of your wallet addresses and any content you submit (e.g., profile name, bio); you grant us a license to use that content to operate and improve the Service.
9. Disclaimers
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DISCLAIM ALL WARRANTIES, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE. USE OF CRYPTOGRAPHIC SYSTEMS AND BLOCKCHAIN INVOLVES INHERENT RISKS INCLUDING HARDWARE FAILURE, BUGS, AND REGULATORY CHANGES.
10. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, ATOMIC AND ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES (INCLUDING LOSS OF PROFITS, DATA, OR ASSETS) ARISING FROM OR RELATED TO YOUR USE OF THE SERVICE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL AGGREGATE LIABILITY FOR ANY CLAIMS ARISING UNDER OR RELATED TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED ONE HUNDRED UNITED STATES DOLLARS (USD 100). SOME JURISDICTIONS DO NOT ALLOW LIMITATIONS ON IMPLIED WARRANTIES OR EXCLUSION OF CERTAIN DAMAGES; IN SUCH JURISDICTIONS, OUR LIABILITY SHALL BE LIMITED TO THE GREATEST EXTENT PERMITTED BY LAW.
11. Indemnity
You agree to indemnify, defend, and hold harmless ATOMIC and its affiliates, officers, directors, employees, and agents from and against any claims, damages, losses, costs, or expenses (including reasonable attorneys' fees) arising from your use of the Service, your violation of these Terms, your violation of any law or third-party rights, or your conduct in connection with conviction locks, trades, or other on-chain activity.
12. Termination
We may suspend or terminate your access to the Service at any time, with or without cause or notice. You may stop using the Service at any time. Termination does not affect obligations that by their nature survive (e.g., disclaimers, limitation of liability, indemnity). We do not control on-chain state; conviction locks or other positions you have already created on Solana may remain governed by the relevant smart contracts and documentation.
13. Changes to the terms
We may update these Terms from time to time. We will post the updated Terms on this page and update the "Last updated" date. Material changes may be communicated via the Service or our official channels (e.g., Twitter @atomic_bags). Your continued use of the Service after the effective date of changes constitutes acceptance of the revised Terms. If you do not agree, you must stop using the Service.
14. Governing law and disputes
These Terms are governed by the laws of the jurisdiction in which ATOMIC operates, without regard to conflict-of-law principles. Any dispute arising out of or relating to these Terms or the Service shall be resolved exclusively in the courts of that jurisdiction, and you consent to personal jurisdiction there. Nothing in these Terms limits your rights under mandatory consumer protection laws in your country of residence.
